Transcript: When President gives disinformation about pandemic, people base decisions on that, and die. Criminal negligence at least -Glenn Kirschner 03/31/20 Stephanie Miller Show

HIGHLIGHT: When the President told us for weeks that Covid-19 is a hoax, that there were only fifteen cases in the United States that will soon go down to zero, that the warm weather will clear this up, and that, and I quote, it's going to disappear like a miracle, Steph, when he told the American people that, some people believed it and they made their decisions based on that information and they went out and they contracted this disease when they didn't need to, and now some will die as a result.

S:  Hi Glenn Kirschner** we would have been seeing you in person this weekend at D.C. Sexy Liberal but- [conversation] People who have such a respect for law and justice in our society like you do, can you believe the impeachment was how long ago, when Adam Schiff was saying you can't count on this President in a crisis to do what is right for this country. This is another version right in front of our eyes- he's favoring certain states, saying he needs a favor though.
GK: Yeah we've got to finish what the Republicans in Congress and the Senate wouldn't finish, and that is a Trump Crimes Commission.  I have a copy of the Mueller Report  a blueprint for the prosecution of Donald Trump and others.  And it's up to us.
S:  Talk about that, DOJ turning over unredacted version of Mueller Report, tell us about that.
GK: So there was a FOIA report, a Freedom of Information Act request that was filed by Buzz Feed and Epic, electronic privacy information center.  They argued that Barr blacked out whole parts of the Mueller Report that we have a right to see and we're going to sue. We have a right to sue under the FOIA laws, Reggie Walton of Federal Court Bench picked up the case- appointed by Reagan, reappointed by H.W. Bush and W Bush, elevated to top by Roberts, not that it should matter.  Judge Walton said Bill Barr is unworthy of belief- I've got his opinion right here, here is some of what Judge Walton said about Bill Barr
Not about Weinstein, or Madoff, he said this about the Attorney general of the United States- he dubiously handled the public release of Mueller Report, he attempts to spin conclusions, bars characterization, has been contradicted directly by the Mueller Report and Bill Barr lacks candor, that's what a federal judge said about the attorney general of the United States.
S:  So what happens now?
GK: What happens now is the unredacted Mueller Report and listen, Steph, here is one page of the Mueller Report (holds up page and another everything is blacked out) it doesn't tell us a whole heck of a lot does it.
S:  Redactions redactions redactions.
GK: They've got the whole dang thing unredacted now and what that means is we'll be able to see what's under those black bars and he's going to be able to tell the Buzzfeed and Epic whether the American people are entitled to see what's under all these redactions. I tried cases in front of Reggie Walton in the nineties in D.C. he will do the right thing by the American people, I trust him to disclose to us what he thinks we're  entitled to know from the Mueller Report.
S: What is the time frame on that?
GK: I think he says he needs time to go through it- this is a hefty report and he needs to make some decisions about what we're entitled to see and what might actually harm ongoing investigations, so let's give Judge Walton the time, it's going to take him a few weeks and then he will turn over to Buzz Feed and to Epic and then it will presumably be turned over to the American people by those news outlets.  What it is we're entitled to see in this report.
S: As you tweeted, I know the governor of Michigan needs ventilators to save lives, I need a favor though.  Again, I read a Lawrence Tribe tweet, when is this criminal, when does it cross the line? Involuntary manslaughter is acting in a grossly negligent manner resulting in the injury or death an act that is substantial in bringing about death.  The amount of Americans who may die due to his incompetence, when does it become criminal negligence?
GK: I believe it is criminal and here's why.  The president of the United States, when he steps in front of a camera and provides information to the American people we are entitled to use that information in making our own decisions.  When he told us for weeks that this is a hoax, that there were only fifteen cases in the United States that will soon go down to zero, that the warm weather will clear this up and that and I quote, it's going to disappear like a miracle.  Steph, when he tells the American people that, some people believe it and they make their decisions based on that information and they went out and they contracted this disease when they didn't need to and now some will die as a result of the President's negligence, stupidity, and callousness.  That's why this has crossed the line into criminal conduct.  Now what would a trial look like, charges would be brought and the president has every right to defend himself with expert testimony by medical professionals and public health who will say, no the president was telling the truth that it would go from fifteen to zero cases, disappear like a miracle and the warm weather would kill this virus.  Let him put up those professionals and then please let me cross examine them.
S:  People have already died, the man who tried the drug without a doctor's supervision, husband died wife in critical.  And then Rudy Giuliani was out doing the same thing yesterday on Fox: Plays clip: 
Rudy: 669 cases treated with droxy medicines with zinc added, and no deaths and many were over seventy years old.
Ingraham: Yeah we're seeing great results.
S:  Again, without a doctors supervision and people have died and there's word people at Fox are worried about a class action lawsuit because of disinformation that they put out. Twitter shut down Rudy from tweeting that, these are drugs not approved people are using without supervision, right?
GK: Yeah and I don't even want to make a joke about people who take medical advice from Rudy Giuliani gets what's coming to them, because you know what, I don't want to paint with a broad brush and say anything derogatory about all of the people who listen to Trump credit what he says.  But the American people who listen to Donald Trump and watch Fox could reasonably believe what they hear and act on it, when I say reasonably- it's not surprising that if that's the only thing you're exposed to, president trump's daily campaign rallies where he yells at reporters and tells Americans what a great job he is doing to kill this virus, some people I think could rely on that and they could reasonably rely on it because it's the president of the United States and Fox News, why shouldn't they rely on that information. But as a result they are killing people, they're putting people in harm's way, they will bear legal responsibility when this is done.

S:  An analogy is we're all trapped in the same car with this drunk driver who's- half of the people are scared like the rest of us the way he driving, we're all going to die.  You've said, Americans are suffering and will continue to suffer as a result of Donald Trump's incompetence malfeasance and stupidity, one how much suffering and two when will next administration hold him accountable. What he's done in Michigan must be investigated as criminal conduct.  Once again, the layers of this- you have evidence not just the NSC playbook, the response team disbanded and ignoring intelligence-
GK: The evidence of criminal liability by Trump and his enablers is pretty clear and people will continue to suffer, the biggest question I have is will the incoming administration have the backbone, fortitude, to do all the hard work of holding these people accountable because if they don’t, we're going to see more of it in the future and if they don’t it will be doing a great disservice to the American people who have suffered as a result of Trump's behavior.
S: Your take on those who made stock sales by Congress members, like Burr, saying he relied only on public news in making his investment decision? I know another legal expert said of course nothing inspired confidence now in the DOJ but the fact he's been told he's a target is not good, normally you complete investigation first. What are chances that only the Democrat [LAUGHS] will be prosecuted?
GK: Yeah when I saw the early reports that there were three Republican investors and one Democrat- [DISCUSSION about illegal stock trade investigation procedures] the fact the FBI has already contacted Burr makes no sense, it shows they're just checking boxes so they can say we're investigating everybody and finding no criminal conduct.  I do not think it's credible he got his juicy inside information as a Senator but didn't use any of it when he was deciding what stocks to buy and dump, he only got that from cable TV. A third grader wouldn't fall for that, only question is do we hold him accountable?
S:  It seems like Dianne Feinstein isn’t in that category, she wasn’t in that meeting and she lost money on her transactions. But here we go again with both sides do it.
GK: If you're running for office, then you should divest yourself from stock. You want my vote, you want to prove that you have my interest, then don’t have financial interest in the game, that's not too much to ask.
